Reporting Terms of Service Violations

If you believe you have received spam, network intrusions or other acts that are violations of the R1 Hosting TOS and AUP, please with full details, including domain names, IP addresses, log files and timestamps where appropriate.

Acceptable Usage Policy and Terms of Service

The following terms of service must be agreed to before you purchase any of our packages. Please read them carefully as failure to abide by them could be grounds for account termination without warning or refund. To summarize:

No spamming or hosting of spamvertisted content.
No illegal content such as 'warez'.
No mail bombing, port scanning or other attacks.
No IRC scripts, programs or services. Exception: Java IRC applets are fine.
No reselling any of our services. However you may for example create POP3 accounts for friends to use provided that overall data transfer use remains within acceptable levels.
Legal adult content is permitted.
You are responsible for keeping backups of any data stored on our servers. This also includes any email and other such files that are stored on the servers.
Background processes or web-based scripts which run in a 'server' state are not allowed.
BitTorrent trackers and CGI/PHP web proxies are not suitable for use on our shared hosting.
A gigabyte of data transfer is considered equal to 1000MB to account for things such as HTTP/TCP headers, FTP and POP3/IMAP usage which is not monitored.
R1 Hosting operates on shared resources. Should your website cause excessive load on our server such that performance is degraded for other customers, we reserve the right to disable or suspend access to the offending site or script without prior notice.
SERVICE IS NOT GUARANTEED. Due to factors beyond our control such as network peer outages it is not possible for R1 Hosting to guarantee 100% availability. Realistically uptime is very good. Please check our independently monitored uptime courtesy of siteuptime.com.
"Unlimited" is within reasonable levels :)
Access to your website will be disabled if you exceed your data transfer limit. At your option, additional monthly data transfer can be purchased in blocks of 1GB for the remainder of the month with a minimum purchase of 5GB at a cost of $0.50 per GB. Any remainder left at the end of the month will not be carried over to the next month.
Upgrading your account type will incur a $5 processing fee plus any additional part of the new monthly fee. Downgrading your account type is free.
Abuse Catchall: We reserve the right to terminate your service at any time without a refund if deemed necessary.

Full Terms of Service

TERMS OF SERVICE
This R1 Hosting Terms Of Service ("TOS") describes the proper kinds of conduct and prohibited uses of R1 Hosting's hosting services (the "Services"). This TOS is not extensive and R1 Hosting reserves the right to modify this TOS at any time without any prior notice, effective upon posting of the modified TOS at www.r1hosting.com. By registering for and using the Services, and thereby accepting the terms and conditions of this TOS, you agree to abide by these conditions as modified from time to time. Any violation of the TOS may result in the suspension or termination (without refund) of your account or such other action as R1 Hosting deems appropriate.

In a nutshell: Please don't do anything illegal with our services. We have and will use our right to suspend or terminate your account without warning if you are hosting illegal pages or files on our servers. You don't have to read through all of this legal text to understand this. If your account is terminated, you will not be reimbursed for any setup fees or extra fees incurred on your account. Bandwidth overage charges are at $0.50 per GB over, and the charge for a technician to fix anything wrong with your account (caused by you) or to remove anything offensive or illegal on your account is $85.00 per hour (rounded to the nearest hour). IMPORTANT NOTE - R1 Hosting has the right to discontinue service, or deny access to anyone who violates our Policies or the terms and conditions shown below WITHOUT WARNING OR PRIOR NOTICE. No refunds or fees paid will be made if an account termination is due to a violation of our terms outlined below.

Website Content:
Your Website content will remain under your domain; your domain will not be made available to any other entity unless you specifically request it. You have the right to retain files that you seek to hold on your Website as long as they do not violate our terms and conditions. You are not allowed to publish any material that under R1 Hosting's discretion: anything which violates local, state, federal, or international laws; threatens the Internet community, encourages criminal mischief, or material that could give rise to civil liability.

Adult Related Websites:
R1 Hosting allows adult content which is permissable by law. Anything depicting beastiality, child pornography, scat pornography, or anything else equally distasteful or illegal will be reported and your site may be terminated or suspended without warning.
 
Warez Sites:
Warez Sites are sites that are typically used by "hackers" to trade (upload/download) illegally pirated copies of software programs with one another. R1 Hosting has a zero-tolerance policy on all Warez Sites. Sites that become a trading post for "warez" programs will be reported to any and all regulatory, administrative, and/or governmental authorities for prosecution. In addition to your account being deleted from our servers, you may face legal action that can be taken against you by R1 Hosting itself as well as the programmers/software companies of the copyrighted software.

R1 Hosting HAS A ZERO TOLERANCE POLICY FOR WAREZ, HACKS, CRACKS, AND SCAM PAGES. 

If you are caught uploading these types of content to our web server you are strictly held responsible, not R1 Hosting. Large fines and penalties may apply, as well as legal action.

Other Unacceptable Content:
Illegal Material or material that is against public policy, material that may be detrimental to the public health, safety, or welfare. (Such as, but not limited to: bomb making, fraud, criminal plots, etc., or anything else that may be considered detrimental or illegal.) R1 Hosting will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to terminate an account at any time for any reason without refund.

Shell Accounts:
Shell accounts are NEVER to be abused or used mis-accordingly. Anyone caught using SSH access for malicious activity will be turned over to the proper authorities.

Reselling:
You may not resell any of our services. R1 Hosting accounts are designed for individual use, however it is permitted to create POP3 E-Mail accounts for friends or relatives providing POP3 bandwidth usage remains within acceptable levels. Giving away free POP3 accounts to the public is not recommended and may cause your account to be suspended if we deem it is causing a bandwidth problem.

IRC & BOTS
We currently do not allow IRC, IRC clients or IRC bots to be operated on any of our servers. In addition, IRC servers are not permitted on our network, as well as BNC accounts, BitchX and any other scripts. Anyone found to be in violation of this policy risks immediate account termination.

Unsolicited Email (Spamming):
Unsolicited commercial advertisements (spam) are not allowed in e-mail, and will likely result in account cancellation.

R1 Hosting takes a zero-tolerance approach to spam originating from our servers or for spam advertising of domains hosted on our servers.

The following activities are not allowed:

Unsolicited bulk or commercial messages ("spam"): This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures, and political or religious tracts. Such messages may only be sent to those who have explicitly requested it from your domain. Forging, altering or removing electronic mail headers is prohibited. Any domain sending stealth spam will be terminated without warning and without refund. Sending numerous copies of the same or substantially similar message with the intent to disrupt a server or account ("mail bombing").

Spamming Newsgroups:
Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such. Mail may not be used to harass or intimidate others. Harassment, whether through language, frequency of messages, or size of messages, is prohibited. Sending a single unwelcome message may be considered harassment. If a recipient asks to stop receiving e-mail, you must not send that person any further messages. Providing spamware (software used to send bulk email or software used to harvest email addresses) or links to sites providing spamware is strictly prohibited and subject to demand for removal or account cancellation.

Note: If you use the services of another provider (including but not limited to the use of address lists obtained from a third party vendor or provider) to promote a web site hosted by or through R1 Hosting (spamvertising), then the provisions of the above Policy shall apply as if the spam were sent through our servers.

Penalty:
Depending on the severity of your SPAMMING, R1 Hosting reserves the right to charge you between $50.00 - $100.00 PER SPAM EMAIL SPAM SENT through our network. (Fee charged at the discretion of R1 Hosting). Your web site content will be confiscated and it will be handed over to legal authorities, as well as logs of your website activity. If a credit card card charge is unsuccessful for penalty fees, R1 Hosting will appoint a credit collection agency to collect penalty applied in which the offender will be liable for all charges incurred to R1 Hosting from the collections agency.

Server Resource Abuse:
Shared server accounts are limited in use of the amount of server resources. Shared server resource abuse includes any process or service usage that affects normal shared server operation, resources or connectivity, and which causes a server to become overloaded. Shared server resources include CPU and memory usage, number of concurrent processes, number of concurrent port or database connections and total bandwidth. Possible causes of server resource abuse include, but are not limited to, the use of: CGI, Perl, Sendmail, mySQL, PHP, HTTP, SMTP, POP3 and FTP. If server resource abuse is detected, possible actions include, but are not limited to: disabling of the offending script or scripts, disabling of the specific service, disabling of the entire account or account cancellation. If server overload is a result of server resource abuse, these actions will be taken without prior notice or warning. Background processes or scripts which enter a 'server' or 'daemon' state are not permitted on R1 Hosting and will be terminated without warning. Further violations may result in account suspension or termination.

Abuse of SMTP Mail Server:
We do not allow clients to send more than 1000 pieces of e-mail per day from a shared hosting account. If you do send more than 1000 pieces of e-mail per day, your account will be placed on hold for Network Abuse. If you are sending legitimate e-mails and they total more than 1000 per day please contact us to make alternative arrangements for your email account. 

Network Abuse:
Shared hosting accounts, as the name implies operate on shared network resources. This means that there are several hosting accounts per server. Excessive use or "abuse" of these network resources by one customer have a negative impact on all other customers. In all fairness, you are not allowed to deliberately consume network resources in an excessive manner, this includes but is not limited to: CPU time, memory, and disk space. You are also not allowed to use resource-intensive programs that can negatively impact other customers or the performance of our systems. High Network traffic and throughput is not a problem for R1 Hosting, but extreme network traffic or uploading and downloading can sometimes create problems. R1 Hosting' servers are configured to shut off any account when its bandwidth allowance is exceeded. You are allowed to exceed your maximum bandwidth allowance without being shut off as long as you notify R1 Hosting in advance, however, you will be billed $1.00 for each additional GB of throughput on your next billing cycle. 

Excessive Use/Overages:
You will not exceed the bandwidth, storage and E-mail usage limits outlined by your particular web hosting package as our system is designed to put your account on hold until you have made arrangements to purchase additional bandwidth for that month. Bandwidth usage figures and additional purchased bandwidth are reset at the beginning of each month. R1 Hosting will not refund any unused pre-paid fees. Your use of your account and access to it is your responsibility. You are responsible for any unauthorized access to your account resulting in bandwidth, storage and/or E-mail usage exceeding the limits outlined in your particular web hosting package specifications and resultant charges. Bandwidth overages are currently billed at $1/GB/month. 

Network Security:
Customers may not use the R1 Hosting network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. R1 Hosting will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability. You are solely responsible for any security breaches affecting servers or accounts under your control. If your server or website is responsible for or involved in an attack on or unauthorized access into another server or system, R1 Hosting will shut it down immediately. You will pay any charges resulting from the cost to correct security breaches affecting R1 Hosting or any of its other customers.

Electronic Commerce:
You will be solely responsible for the development, operation and maintenance of your online store and products and all contents and materials appearing online or on your products, including without limitation (a) the accuracy and appropriateness of content and materials appearing within the store or related to your products, (b) ensuring that the content and materials appearing within the store or related to your products do not violate or infringe upon the rights of any third party, and (c) ensuring that the content and materials appearing within the store or related to your products are not libelous or otherwise illegal. You will be solely responsible for the final calculation and application of shipping and sales tax. You will also be solely responsible for accepting, processing, and filling any customer orders, and for handling any customer inquiries or complaints arising there from.

You are also responsible for the security of any customer credit card numbers and related customer information you may access as a result of conducting electronic commerce transactions through your Web Site. You will keep all such information confidential and will use the same degree of care and security as you use with your confidential information.

Website Ownership:
All Web Hosting accounts are designed to be used by one individual or entity. Customers may not resell space or bandwidth located under the customer's domain without the explicit consent of R1 Hosting. Violation of this may result in termination of the account without a refund.

Payment Policies:
All accounts are set up on a pre-pay basis. All pricing is guaranteed for the term of pre-payment. R1 Hosting reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within two weeks (14 days) of e-mail notice or exceeding this time frame in any way is subject to suspension with a $25 reactivation fee. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies R1 Hosting at sales@r1hosting.com to request for termination of services. 

All R1 Hosting accounts are setup daily. Your particular billing cycle corresponds to the day you made payment on account and the contract length that was initially chosen at setup. Your account will automatically renew at this length unless otherwise stated.

Cancellation
R1 Hosting reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by R1 Hosting if R1 Hosting institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the customer.

Cancellation of the service can be performed by contacting support through the R1 Hosting account manager. It is your responsibility to take a copy of any data stored on our server(s) before cancelling your account as any data you have stored on our server(s) will be erased upon account cancellation.

Liability and Obligations on Cancellation:
If the Agreement expires or is cancelled for any reason, R1 Hosting is not liable to you because of the expiration or cancellation for compensation, reimbursement or damages on account of the loss of prospective profits, anticipated sales, goodwill or on account of expenditures, investments, leases or commitments in connection with your business, or for any other reason whatsoever flowing from the termination or expiration. If you terminate this Agreement, R1 Hosting will not relieve you of any obligations to pay fees and costs accrued before the termination date or any other amounts you owe to R1 Hosting under this Agreement.

Interruptions of Service:
Due to the nature of the service provided, an interruption could occur for many reasons beyond R1 Hosting's negligence. Damages resulting from any interruption of service are too difficult to ascertain. R1 Hosting shall not be liable for any damages that arise from such causes. R1 Hosting's liability for its own negligence may not in any event exceed an amount equivalent to charges payable for your specific hosting plan during the period damages occurred.

Data Backups:
It is your responsibility to maintain a current back up of your files and folders.

Generic Abuse Catchall:
If it is deemed that you are abusing the R1 Hosting server or network resources in any way not otherwise covered by these Terms of Service we may terminate your account without notice and without refund if deemed necessary.

Limitation of Liability:
In no event shall R1 Hosting be liable for damages resulting from loss of data, profits, or for any incidental, indirect, punitive or consequential damages in connection with these terms and conditions or in connection with any web hosting account. In no event shall R1 Hosting's cumulative liabilities exceed an amount equivalent to charges payable for your specific hosting plan during the period damages occurred.

Technical Support:
You are entitled to receive free technical support, however, technical support is only available via the means listed on the support section of www.r1hosting.com, and is limited to issues directly related to server connectivity, http, ftp and email services functioning abormally, or requests for modules/additional software to be installed. For a $75/hour fee, R1 Hosting may answer any questions you have outside of these categories. You will be notified should this fee apply to your question.

R1 Hosting does not provide technical support for configuring, using and/or troubleshooting third party applications including but not limited to: Mailing Lists, MySQL Databases, Shopping Carts, Forums, PHP/CGI Scripts. Most answers to your questions are available elsewhere on the Internet.

Indemnification:
Customer agrees to defend, idemnify and hold harmless R1 Hosting against any liabilities arising out of; (1) any damage to person or property caused by any products sold or otherwise distributed in connection R1 Hosting 's servers; (2) Any material supplied by the customer which is directly infringing (or) allegedly infringing on the proprietary rights of a third party; ( 3) Copyright infringement and (4) Any defective products or services sold to customer from R1 Hosting's servers. 

Disclaimer
R1 Hosting will not be responsible for any damages that your business(es) or site(s) may suffer. R1 HOSTING MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. R1 HOSTING DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY R1 HOSTING AND ITS EMPLOYEES. R1 HOSTING RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME WITHOUT PRIOR NOTICE. FAILURE TO FOLLOW ANY TERM OR CONDITION WILL BE GROUNDS FOR IMMEDIATE ACCOUNT DEACTIVATION.
